Reasons
Punishment of the crime
On August 17, 2012, the Defendant was sentenced to a suspended sentence of two years for six months of imprisonment due to occupational embezzlement, etc. in the Changwon District Court’s branch branch on August 17, 2012, and the said judgment became final and conclusive on January 30, 2013.
The Defendant, from February 201 to January 2012, 201, worked as an employee of the tourr, etc. of the trade name AD Co., Ltd., Ltd., AD located in Gyeongnam-gun AC, and was in charge of duties, such as the reservation of airline tickets and the right to create tickets. From January 2012, the Defendant solely carried out aviation ticket reservation and the right to create tickets, and the victim AE Co., Ltd. was a travel agent on whose behalf the Defendant was working.
1. Fraud against the victim AE corporation;
A. On January 10, 2012, the Defendant: (a) made a false statement to the “AD” office located in Seongbuk-gun AC; and (b) called “IE office, the head of the Victim AE Co., Ltd., by phone calling to X, the head of the office of the Victim AE Co., Ltd.; and (c) on January 11, 2012, the Defendant issued one copy of the Egypt aviation ticket starting from the Incheon State’s port of supply, i.e., transfer the price immediately following the following day.”
However, at the time of fact, the Defendant promised a superior class air ticket to the customer who requested the reservation of air tickets because he had been employed as an employee by the travel company, such as AD, etc. at the time, and promised to use the bonds from H, G, etc. to pay the difference due to the reason that the Defendant bears the burden on the Defendant, etc., and used the bonds from H, G, etc. to pay the purchase price of the tickets from other air tickets, and the so-called Incheon Karopy ticket that is used to pay the above debt. The above Incheon Karopy ticket that the Defendant requested the victim to issue was also planned to pay the air ticket to the customer "AF" for the purpose of paying the above debt. Thus, the above air ticket is paid even if the Defendant received the above air ticket from the victim.
