A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. 특정범죄 가중처벌 등에 관한 법률위반( 위험 운전 치상) 피고인은 B 포르테 쿱 승용차의 운전업무에 종사하는 사람이다.

피고인은 2017. 3. 18. 13:40 경 혈 중 알콜 농도 0.128% 의 술에 취하여 보행상태가 비틀거리고 발음상태가 어눌한 등 정상적인 운전이 곤란한 상태에서 위 포르테 쿱 승용차를 운전하여 서울 중랑구 C 앞 편도 4 차로를 상봉동 방향에서 묵동 방향으로 2 차로를 따라 진행하게 되었다.

그럼에도 불구하고 피고인은 이를 게을리 한 채 술에 취하여 전방 주시 의무를 태만히 하고 조향 및 제동장치를 제대로 조작하지 못한 과실로, 전방에서 진행 중이 던 위 인 피니 티 승용차의 뒷 범퍼 우측 부분을 위 포르테 쿱 승용차의 앞 범퍼 좌측 부분으로 들이받았다.

결국 피고인은 위와 같은 업무상의 과실로 위 포르테 쿱 승용차를 운전하여 피해자에게 약 2 주간의 치료가 필요한 경추의 염좌 및 긴장 등의 상해를 입게 하였다.

2. 도로 교통법위반( 음주 운전) 피고인은 2017. 3. 18. 13:40 경 서울 중구 신당동 122-5 앞 도로에서부터 서울 중랑구 C 앞 도로에 이르기까지 약 13km 구간에서 혈 중 알콜 농도 0.128% 의 술에 취한 상태로 B 포르테 쿱 승용차를 운전하였다.
