Defendant
A shall be punished by a fine for negligence of KRW 9,000,000, and by a fine of KRW 3,000,000.
The Defendants respectively.
Reasons
Punishment of the crime
[2017 High 428] Defendant B was sentenced to a suspended sentence of two years in one year and six months for a violation of the Petroleum and Petroleum Substitute Fuel Business Act at the source of water supply in February 10, 2017. The judgment became final and conclusive on November 30, 2017.
1. No person shall manufacture, import, store, transport, store or sell fake petroleum products;
Nevertheless, from around 10:19 on November 24, 2015 to around 11:22 of the same day, the Defendant: (a) was a waste collection company located in D in the former Eup/Myeon; (b) at the F tank 28,000 liter vehicle (storage capacity 28,000 liter) operated by the Defendant; and (c) transported 28,000 liters manufactured by the said company to the “H gas station” located in the wife population G in Yongsan-si.
In addition, from that time until December 28, 2015, the Defendant transported a total of 196,000 liters of fake petroleum products (fus transit) by the aforementioned method seven times, such as the list of crimes in the attached Table.
2. No person shall manufacture, import, store, transport, store or sell fake petroleum products.
Nevertheless, between November 12, 2015 and 09:21 on the same day, the Defendant: (a) from around 08:52 to from around 09:21, the foregoing (ju) E plant; (b) from the Defendant’s operation on the I home-ro tank clock vehicle (storage capacity of 3,000liters) manufactured by the said company; (c) transported a fake petroleum product (c) 3,000-liter from the said company to the “K Storage” located in the Geumsan-gun, Chungcheongnam-gun.
[2017 High 455(Defendant A)] No person shall manufacture, import, store, transport, store or sell fake petroleum products.
1. On September 14, 2015, from around 15:30 to around 16:33 of the same day, the Defendant: (a) from the “K Manufacturing Factory” located in the Chungcheongnam-gun, Chungcheongnam-gun; (b) from the “K Manufacturing Factory,” the Defendant’s operation on the F tank 20,000-liter vehicle (storage capacity 28,000-liter) manufactured in the said plant; and (c) from the “N stations” operated by M in the Special Self-Governing City L of Sejong-do.
