1. The plaintiff's claim that is changed in exchange in the trial is dismissed.

2. All costs of the lawsuit shall be borne by the Plaintiff.

The Plaintiff asserted that the establishment registration of mortgage contract concluded on June 1, 2007 between the Defendant and Qu Construction Co., Ltd. constitutes a false conspiracy and invalid registration. Therefore, the establishment registration of mortgage right as stated in the purport of the claim based on this claim should also be cancelled as a cause invalidation. However, it is insufficient to recognize the fact that the establishment registration of mortgage contract between the Defendant and Qu Construction Co., Ltd. was concluded by a false conspiracy, and there is no other evidence to acknowledge it.

Therefore, the plaintiff's claim that is changed in exchange at the trial of the party is dismissed as it is without merit (the lawsuit for revocation of fraudulent act, which is the previous lawsuit, was withdrawn from the exchange change of the lawsuit at the trial of the party, and the judgment of the first instance was invalidated) and it is so decided as per Disposition
