A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant worked as the store store from around 2012 to around 2016 at the H’s mobile phone agency located in Daegu Suwon-gu G.

1. Crimes related to fraudulent use under the name of the FA;

A. On December 8, 2015, the Defendant was an agent of the aforementioned mobile phone at a mobile phone agency around December 8, 2015, and was an agent of the aforementioned mobile phone.

With a view to facilitating administrative affairs by using the FA’s identification card in which the FA’s identification card is stored, the name, date of birth, contact number, etc. of the FA is entered, the applicant/subscriber voluntarily signed the FA’s “FA” column to prepare one copy of the file of the new application form in the private electronic records, and the aforementioned new application form is sent to the KT by pretending that it is the electronic records duly formed.

Accordingly, the defendant forged a copy of a new application file of a private electronic cell phone for the purpose of making administrative affairs smooth, and exercised it.

B. The Defendant sent one copy of the “loleh new application” file in the name of FA written in FA as stated in the above 1-A, at the time and place of the above 1-A, as if the FA applied for a new mobile phone, and then acquired it by the said employee after receiving one file of the “loleh new application” file in the name of FA written in 1-A, as described in the said 1-A, by allowing the said employee to open one cell phone and delivering one cell phone in the amount of KRW 99,900 at the market price.

2. Crimes related to fraudulent use under the name of the FB;

A. On December 24, 2015, the Defendant: (a) was a mobile phone agency customer at the foregoing mobile phone agency around December 24, 2015; and (b) was a mobile phone agency.

The FB’s identification card is connected to the smart application system of KT without authority for the purpose of facilitating administrative affairs by using the identification card of the FB, enter the name, date of birth, contact number, etc. of the FB, and sign “FB” at will in the application/ subscriber column.
