The judgment of the court below is reversed.

Defendants shall be punished by imprisonment for ten months.

However, for two years from the date this judgment becomes final and conclusive.

1. Summary of grounds for appeal;

A. Error of facts and misapprehension of legal principles were issued only in each game of this case, and since customers could not be transferred to others through identification process when they use the above card, there was no fact that they were involved in money exchange or impliedly engaged in speculative acts or encourage speculative acts.

B. The sentencing of the lower court (one hundred months of imprisonment) is too unreasonable.

2. Ex officio decision (Defendant A)

가. 당심에서 변경된 공소사실 피고인은 P과 함께 2013. 5. 24.경부터 2013. 2014. 1. 29.경까지 대전 중구 G에서 ‘H게임장’을 운영하면서, 청소년 이용불가 비경품게임인 ‘슈퍼드래곤' 게임기 90대를 설치하고, 게임기의 'START’ 버튼을 자동적으로 눌러주는 속칭 ‘똑딱이’ 장치를 구비한 후, 그곳을 찾은 손님들이 게임기에 현금 10,000원을 넣으면 게임 화면 좌측 하단 ‘CREDIT’창에 10,000점이 생성되고, ‘똑딱이’ 장치를 위 게임기 ‘START’ 버튼 위에 올려놓으면 게임이 자동으로 실행되어 1게임당 100점씩 감소하며 우연한 결과에 따라 게임 화면 속에 5장의 카드의 그림 및 숫자의 조합이 바뀌면서 그 정해진 규칙에 따라 최소 100점에서 최대 300,000점까지 점수를 획득하고, 그 점수는 화면 우측 하단 ‘BANK’창에 적립이 되어 ‘BANK’창에 적립된 점수를 이용하여 게임을 실행할 수 있고, 이 경우 1게임당 200점씩 감소하는 대신 획득하는 점수가 2배가 되도록 선택할 수 있으며, 손님들로부터 위 'BANK’ 및 ‘CREDIT’창에 적립된 금액의 반환을 요구받으면 그 해당 점수를 점수보관기능이 포함된 회원카드에 입력하여 발행해 줌으로써 위 카드에 입력된 금액 상당의 교환가치를 부여하고, 손님들 또는 제3자로부터 카드의...
