1. The Defendant, on January 16, 2013, posted the victim C’s photograph and name on the Internet site “Spebbe.com” bulletin board at the place of residence located in Daegu-gu B and A 102, Daegu-gu, and Dong 102 on January 16, 2013.

그리하여 피고인은 위 게시글의 댓글란에 닉네임 'D'를 이용하여 “병신ㅋㅋㅋㅋㅋㅋㅋㅋㅋ”라는 댓글을 게시하여 피해자 C을 모욕하였다.

2. The facts charged in the instant case are the crimes falling under Article 311 of the Criminal Act, which can be prosecuted only upon the complaint of the victim under Article 312(1) of the Criminal Act.

However, according to the trial records of this case, the victim can recognize the cancellation of complaint against the defendant on December 19, 2014, which was after the prosecution of this case.

Therefore, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
