1. 공소사실 피고인은 2014. 1. 5.경 장소를 알 수 없는 곳에서 ‘일간베스트저장소(www.ilbe.com)’ 사이트에 자신의 아이디 ‘B(닉네임 ‘C’)로 접속한 후, 피해자 D이 “아들 엄마야 ”라는 제목으로 인터넷 개인방송 ‘E'에 대한 공개 광고글을 게시하자 그 댓글란에 “뒤저라 씨발아 ㅁㅈㅎ”이라고 게시하였다.

Accordingly, the defendant openly insultingd the victim.

2. The facts charged in the instant case are crimes falling under Article 311 of the Criminal Act, and can be prosecuted only when the victim files a complaint under Article 312(1) of the Criminal Act.

However, on February 26, 2015, which was after the prosecution of this case was instituted, the victim can recognize the fact of revoking the complaint against the defendant. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.
