Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Criminal facts

The defendant is a person engaged in meat packaging business from January 1, 2008 to Busan Gangseo-gu corporation E in the trade name.

1. Violation of the Sanitary Control of Livestock Products Act;

(a) Each meat packaging business operator shall indicate the name of a product, type of processed livestock products, name of a place of business and sub-place of business, date of manufacture, manufacturing date, quantity of products, names of raw materials, ingredients and contents, ingredients names and contents, nutrition ingredients, etc. in accordance with the classification publicly notified by the Minister of Food and Drug Safety concerning the labelling of livestock products, and shall not sell them for sale, or process, pack, store, transport or display them for sale without indication;

Nevertheless, at around 13:50 on August 18, 2015, the Defendant kept livestock products worth 412,000 won in total, including 11kg (5,000 won), 4kg (42,000 won), and 70 km (315,000 won) of Germany’s imported swine.

(b) Each meat packer shall prepare documents, etc. concerning production and work records in order to ascertain the production and sales volume by making use of raw materials and recording the details of sale thereof, and keep them for two years from the date of the last entry, and issue receipts, documents, etc. stating the kinds, origin, rating, serial numbers of meat used for making packaged meat to the meat sale business or food entertainment business operator;

Nevertheless, the Defendant, from January 1, 2008 to August 19, 2015, did not prepare documents, etc. on the production and work records in Company E, and did not issue a transaction statement prescribed by law by failing to indicate a serial number in the transaction statement, on the restaurant “G” located in Seo-gu, Busan from August 19, 2013 to August 19, 2015.
