Defendant shall be punished by a fine of one million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant is a person who sells meat of livestock products under the name of “C” in Daegu Northern-gu B.

1. No livestock product sales business operator and meat packaging processing business operator shall sell, or store for sale, livestock products the distribution deadline of which expires, as indicated on the livestock products;

From March 10, 2016, at around 16:40, the Defendant kept 2.9 km for the purpose of selling 2.9 km, the distribution period from October 31, 2015 to December 14, 2015.

2. Any business operator selling livestock products and meat packaging and processing business operator shall comply with the standards and ingredients specifications in relation to the collection and treatment of livestock and processing and packing and distribution of livestock products;

In the case of meat processed products and packaged meat, -2 to 10 degrees (Provided, That in the case of meat packaged meat products, -2 to 5 degrees), freezing products shall be preserved and distributed at not more than -18 degrees.

However, the Defendant violated the standards for the preservation of livestock products by preserving at freezing 1.7km and Korea-Japan 1.5km for sale at the same time and place as in the preceding paragraph.

1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;

The grounds for the sentencing of Articles 70(1) and 69(2) of the Criminal Act to attract the workhouses are divided, and there is no record of criminal punishment except for the one sentenced to one fine due to the injury crime and the violation of the Quality Control of Agricultural Products Act, and the fact that it appears as a small business operator and the amount of violation is not high.
