All appeals are dismissed.
Reasons
The grounds of appeal are examined.
1. As to the Defendant’s grounds of appeal, the lower court found the Defendant guilty of violation of the Act on the Control of Narcotics, Etc. due to the administration of Metepia, etc., listed in No. 26 listed in the first instance judgment among the facts charged in the instant case, on the grounds indicated in its reasoning.
The judgment below
Examining the reasoning in light of the evidence duly admitted by the lower court, the lower court did not err by misapprehending the facts contrary to logical and empirical rules, contrary to what is alleged in the grounds of appeal.
Meanwhile, although the Defendant appealed to the entire judgment of the court below, the remaining guilty portion which the court below found guilty did not state the grounds for appeal, nor did it state the grounds for appeal as to the grounds for appeal.
2. On the grounds of appeal by the prosecutor, the court below reversed the judgment of the court of first instance convicting the Defendant, and acquitted the Defendant, on the grounds that there was no proof of crime as to the violation of the Act on the Control of Narcotics, etc. due to the administration of Metetrac medication as stated in the attached Table Nos. 11, 14, 18, and 25 among the facts charged in the instant case.
The judgment below
Examining the reasoning in light of the record, the lower court did not err by misapprehending the legal doctrine on the evidence of confession, contrary to what is alleged in the grounds of appeal.
Meanwhile, although the prosecutor appealed to the entire judgment of the court below, it did not state the grounds for appeal as to the guilty portion, nor did it state the grounds for objection in the appellate brief.
3. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
