The judgment below

In light of the records, the court below reversed the judgment of the court of first instance which found the Defendant guilty on the violation of the Act on the Promotion of Game Industry among the facts charged in this case on the grounds as stated in its reasoning and found the Defendant not guilty, and there is no error of exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or of misapprehending

Meanwhile, although the prosecutor appealed to the entire judgment of the court below, it did not state the grounds for appeal as to the guilty portion, nor did it state the grounds for objection in the appellate brief.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
