A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 20, 2008, the Defendant was sentenced to a fine of two million won for the crime of violation of the Road Traffic Act at the Jung-gu District Court on June 20, 2008, and a fine of three million won for the same crime at the same court on November 20, 2008, respectively. On January 19, 2012, the same court was sentenced to a suspended sentence of two years for imprisonment with prison labor for the same reason of violating the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury on Dangerous Driving) and is still under the suspended sentence.

1. On March 1, 2013, the Defendant was driving a D-sports car without a driver’s license in the direction of “7080 main points located in Jung-gu Seoul Metropolitan City, Jung-gu, to the Defendant’s residential area adjacent to the Defendant’s residential area in Jung-gu, Gyeonggi-si, while under the influence of 0.062% of the blood alcohol concentration without a driver’s license.

2. The Defendant, as stated in the above Paragraph 1, was investigated into the E-district of the Guri Police Station by committing the crime of drinking and driving without a license as stated in the above Paragraph 1, had F make a false statement to the effect that he was driving the said car on behalf of the Defendant at the time of the foregoing Paragraph 1.

At around 22:20 on March 1, 2013, the Defendant walked a cell phone phone used by F in the above E zone and called “NNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNYYYYYYYYYNNNNNNNNNYYYYYYYYYNNNNNNNNNNYYYYYYYYYNNNNNNNNNNNNNYYYYYYNNNNYYYYYYYYNNNNNNYYYYNNNNYYYYYYYNNNNNNYYYYYYNNNNYYYNNNNYYYYNNNNYYYYYNNNNYYYYYNNNYYYY.
