A. The lower court determined as follows based on the evidence duly adopted and examined.

① ㉠ 피고인이 일관되게 ‘ 식칼을 들고 소파에서 일어나려는 순간 테이저건을 맞았을 뿐, 식칼을 E에게 휘두르거나 들이대지 않았다’ 고 진술하고, 폴리 그래프 검사 결과 피고인의 진술이 진실한 것으로 판정된 점, ㉡ 피고인의 구체적인 협박 행위에 대한 E의 진술이 일관되지 않은 점, ㉢ 사건 당시 촬영된 사진들에 의하면 E의 진술과 같은 상황( 피고인과 E이 마주보고 있는 상태에서, 피고인이 E을 향해 움직였거나 움직이려고 하는 상황 )에서 테이저건이 발사된 것이 아닐 수 있다는 의심이 드는 점, ㉣ 오히려 테이저건의 탄착점에 비추어 보면, 피고인의 진술대로 피고인이 소파에서 일어서려는 순간 테이저건이 발사되었을 가능성을 배제할 수 없는 점, ㉤ E은 ‘ 피고인이 식칼을 든 채 죽여 버린다고 말하였다’ 는 취지로 진술하였으나, 녹음 파일 등 객관적인 증거가 제출되지 않아 쉽게 믿을 수 없고, 피고인이 ‘ 죽여 버린다’ 고 말하였다고
