A defendant shall be punished by imprisonment for not less than three months.

Punishment of the crime

On September 26, 2014, the Defendant was sentenced to one year and six months of imprisonment at the Gwangju District Court for embezzlement, etc., and the judgment became final and conclusive on December 24, 2014, and is currently being executed in the Southern Prison.

The area of C forest land 44,426 square meters in Jeonnam-gun, Jeonnam-gun was divided on March 29, 1984 and part of it was D forest land 7,044 square meters in size, and the said D forest was divided on November 21, 2007 and part of it was E forest land 3,122 square meters in size.

On July 6, 1984, the Defendant completed registration of ownership transfer pursuant to the Act on Special Measures for the Registration, etc. of Ownership of Real Estate in the name of the Defendant with respect to 5,887 square meters and 7,044 square meters of 5,887 square meters and D forest owned by the victim Franchi owned by the victim Franchis (hereinafter “victim’s clan”), and had the victim’s clan store the said D forest and G forest including the said E for the sake of the victim’s clan.

After the division in around 2010, the Defendant came to know that some of the above D forests and fields were scheduled to be expropriated due to a project to create a regional industrial complex, and thus, the Defendant was required to relocate a tomb in the above forest and field. On October 7, 2010, the Defendant reported to the head of the Gun/Gu of the above Myeongwon-gun on the opening of a tombstone, which is a grave of the victim's clan that was located on the ground of the above D forests and fields, on the second and the first opening of the tombstone, which is a grave of the victim's clan in the above Myeongwon-gun Office.
