Reasons
Punishment of the crime
[criminal power] On December 9, 2010, the Defendant was sentenced to six months of imprisonment with prison labor for larceny in the Young-gu District Court’s Young-dong Branch, and on April 26, 201, four times of the same kind of power, including the completion of the execution of the sentence in the Cheongju Prison.
【Criminal Facts】
The Defendant: (a) was a person who works for a singing room in Chungcheong-gun C; (b) was an employee in a singing room in Chungcheong-gun C; and (c) was in the heart of finding the drinking value from a drunk customer, using the fact that the customer did not return his/her card under the influence of alcohol; and (d) had the drinking value to the customer; and (c) had the said card to withdraw cash.
1. On March 9, 2012, the Defendant: (a) at the “D” singing room, he works as his employee in the Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-do; (b) withdrawn cash to pay the drinking value from the victim E ( South and 43 years old) who is the customer; (c) received one copy of the Nong C Card and withdrawn the cash; and (d) did not return the said C Card to the victim.
Accordingly, the defendant embezzled the victim's property.
2. Larceny;
A. On March 10, 2012, around 01:38, the Defendant withdrawn KRW 9.50,00 through four times the following methods: (a) the NAC card issued from E at F convenience stores located in the Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun; and (b) the password was entered in a cash withdrawal machine managed by the victim agricultural cooperatives located in the above convenience store; and (c) the Defendant stolen it.
B. Around 21:00 on March 10, 2012, the Defendant transferred KRW 300,000,000 to the Agricultural Cooperative Account in G’s name by inserting the Agricultural C&C card received from E in a cash withdrawal machine managed by the victim’s stable, which is installed at the above location, and inputting the password, and then withdrawing KRW 1 million in cash.
C. On March 11, 2012, the Defendant received from the Livestock Cooperative Bank located in the Geumcheon-gun, Macheon-gun, Macheon-gu, Macheon-gu, Macheon-do, the Defendant received from E as above.
