A defendant shall be punished by imprisonment for not less than one year and six months.

80,000 won shall be additionally collected from the defendant.

Punishment of the crime

[Criminal Power] On April 28, 2011, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the Seoul Eastern District Court on April 28, 201, and completed the execution of the sentence in the Incheon Prison on September 6, 2012.

【Criminal Facts】

Even if the Defendant is not a person handling narcotics, the Defendant dealt with the Metropha (the continuous philopon; hereinafter referred to as the “philopon”) as follows:

1. On October 2012, the Defendant: (a) received from a policeman C with the request of “scoponing phiphones”; (b) around 10:00 on October 2, 2012, from F’s numberless vehicle parked in the vicinity of Gangseo-gu Seoul Metropolitan Government D E, a 0.7g of philopon contained in F for one-time use from F; (c) around 14:00 on the same day, the Defendant sent the philopon to C at the seat of the mutual scopon located in Gyeonggi-gu, U.S. G located in Gyeonggi-gu, Gyeonggi-do, and received 700,000 won of philopon from F to C, namely, the amount of philopon from C.

In addition, at around 16:50 on the same day, the Defendant served 700,000 won of philophones received from C as above from H in the street near Gangseo-gu Seoul Metropolitan Government H.

Accordingly, the defendant assisted the trade of philophones between C and F.

2. On March 2013, the Defendant received and possessed 19:00 on the date, and received approximately 0.8 grams of philopon from the line of his name in front of the Gwanak-gu Seoul Special Metropolitan City I building, one disposable injection device containing approximately 0.8g of philopon, and one disposable injection device containing approximately 0.4g of philopon, respectively, without compensation, and received approximately 1.2g of philopon in total.

In addition, from May 21, 2013 to May 15:30, 2013, the Defendant divided the remainder, excluding approximately 0.69gg and approximately 0.3g of 1.08g of phiphonephonephones received from KS 505 located in Gwanak-gu in Seoul Special Metropolitan City, into approximately 0.69g and approximately 0.3g of f.m., and included one-time injection in the small hand room.
