1. The Defendant’s KRW 31,001,094 as well as 6% per annum from June 14, 2014 to June 27, 2014 to the Plaintiff.

Comprehensively taking account of the purport of the entire argument in Gap evidence No. 1, it can be acknowledged that the plaintiff was employed by the defendant and provided labor from April 10, 2001 to June 13, 2014, and did not receive retirement allowances of 31,001,094 won from the defendant.

According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 31,001,094 won and damages for delay calculated at the rate of 6% per annum under the Commercial Act from June 14, 2014 to the 14th day from the date following the date of retirement of the plaintiff, and 20% per annum under the Labor Standards Act from the next day to the date of full payment.

Therefore, the plaintiff's claim is justified and it is so decided as per Disposition.
