피고인은 2016. 3. 12. 03:10경 고양시 일산동구 위시티4로 80 위시티자이1단지 101동 앞 노상에서, 택시요금 지불해 줄 것을 요구하는 택시기사 B에게 “개새끼”, “니가 60이면 내가 70이다 이 개새끼야” 욕설을 하여, 위 B로부터 도움을 요청받은 피해자 일산경찰서 C파출소 소속 경위 D이 택시 요금 지불 후 귀가할 것을 요청하자, B가 듣고 있는 가운데 피해자에게 “씨발 내가 뭘 잘못했는데, 씨발새끼야, 씨발놈아.”라는 취지로 욕설을 하여 공연히 피해자를 모욕하였다.
