피고인은 2013. 12. 25. 05:20경 서울 마포구 B 앞길에서 피고인이 택시에 탑승하였음에도 요금을 지불하지 않는다는 112 신고를 받고 현장에 출동한 서울마포경찰서 C지구대 소속 경찰관 D에게 택시기사 E 및 지나가는 행인들이 지켜보는 가운데 "씨발새끼야 내가 뭘 잘못했는데, 씨발"이라고 말하여 공연히 피해자를 모욕하였다.
