피고인은 2014. 03. 25. 03:58경 광명시 B에 있는, C파출소 앞 노상에서 택시기사 D가 운행하는 E에 승차하여 택시비를 지불치 않고 욕을 한다는 신고를 받은 광명경찰서 C파출소 근무자 경사 F이 택시요금을 지불 후 귀가하라고 요청하였으나 이에 불응하고 택시 조수석에 앉아 피해자 경사 F을 향하여 "야! 씨발새끼야. 씨발놈, 내가 뭘 잘 못했는데, 택시요금 내면 되잖아. 야 이 미친놈아!"라고 택시기사 있는 자리에서 공연히 모욕하였다.
