Reasons
Punishment of the crime
1. On November 201, 2016, Defendant A opened a gambling place: (a) closed down F in Gangnam-si, and opened gambling with other players, including Defendant B; (b) opened gambling places; (c) opened gambling places; (d) opened gambling places; and (d) opened gamblings with other players; (c) received fee per hour (hereinafter referred to as “pambing expenses”); (d) Defendant A provided the above office, gambling, etc. and managed profits from the opening of gambling places; (d) Defendant B responded to the gambling participants; and (e) lent the gambling (hereinafter referred to as “pambling site”); and (e) provided the gambling places to the gambling participants’ office in cases where it is difficult to open gambling places.
On December 3, 2016, the Defendants conspired as above, and opened a place where gambling was conducted for the purpose of profit-making in total 23 times, such as in the attached Table, from January 22, 2017 to January 22, 2017, by allowing persons participating in gambling, such as sexual H, sexually infinites I, sexually infiniteJ, sexual K, sexually infinite L, and sexually infinite L, etc., to gambling, and receiving 20,000 won per hour from the participants of gambling.
2. Defendant C was aware of the opening of a gambling place at the same time and at the same place as set forth in paragraph (1) of the above above, and, even with knowledge of the opening of a gambling place for the purpose of profit-making purpose, Defendant C used a customer’s scambling at the place, made a call to confirm whether he/she participated in the gambling, and made it easy for Defendant C to commit the act by means of settlement, such as receiving money in lieu of money, and by means of settlement, such as receiving it in lieu of money.
