Punishment of the crime

피고인들은 안산 등 경기 남부 지역 일대에서 수사기관의 단속을 피하여 펜 션 등을 돌아다니면서 속칭 ‘ 도리 짓고땡( 마 발이)’ 도박장을 개설하기로 마음먹고, 피고인 A은 도박판 전체를 기획관리하고 도박판을 운영하는 책임자 역할( 속칭 ‘ 총’) 을, 피고인 B은 패를 돌리고 도박 승패에 따라 도박 참가자들 로부터 돈을 걷어 들이거나 도박 참가자들에게 돈을 분배하는 역할( 속칭 ‘ 상 치기’) 을 담당하기로 상호 공모하였다.

이에 따라 피고인들은 2015. 1. 20. 경 안산시 단원구 D에 있는 E 펜 션에서 F 등 약 20명의 도박 참가자들을 불러 모은 다음 화투를 3패로 나누어 ‘ 총’ 이 우선 패를 선택하고, 도박 참가자들이 ‘ 총’ 이 선택하지 않은 나머지 패 중 하나를 선택하여 돈을 걸고 끝자리 숫자의 합이 높은 패가 이기고 그 패에 돈을 건 사람들이 판돈을 나누어 가지는 방법의 도리 짓고땡( 마 발이) 도박을 하게 하여 도박을 하는 장소를 개설하였다.
