Reasons
Punishment of the crime
On April 30, 2004, the Defendant was sentenced to a fine of KRW 1,00,000 on September 7, 2006, on the grounds of the charge of forging Private Document, etc. at the Seoul Eastern District Court, which was sentenced to a fine of KRW 2,00,000 on May 16, 201 to a fine of KRW 2,00,000 on September 7, 2006 for the charge of forging Private Document.
1. Crimes against the victim B;
A. On March 7, 2013, the Defendant forged private documents: (a) around 13:00, on the name column of a new contract form for mobile phone service, which was kept in Busan Jung-gu mobile phone agency D at 19 mobile phone agencies; (b) stated “E” in the name column of a new contract form for mobile phone service, E’s resident registration number in the resident registration number column and the applicant customer column, and signed on the name side.
Accordingly, for the purpose of exercising, the Defendant forged a new contract for mobile phone service in the name of E, a private document on rights and obligations.
B. The Defendant, at the time and at the place specified in the preceding paragraph, exercised the instant investigation document’s new contract form as if it were a document duly formed, with the agency employees B, who knew of the forgery.
C. On the date and time stated in the preceding paragraph, at the same place, the Defendant submitted to the victim B a new contract for the aforementioned forged mobile phone service, and his/her identification card is following the next day to open the cell phone first, and the Defendant was issued one of Samsung Gallon 2 smartphones from the victim, namely, at the victim’s seat, equivalent to KRW 1,089,00 at the market price.
2. Crimes against victim F;
A. On March 9, 2013, the Defendant forged private documents: (a) around 13:00, the Defendant entered “E” in the name column, E’s resident registration number in the resident registration number column, and the applicant customer column into the name on the new contract form for the service that was kept at the mobile phone agent H located in Busan Jung-gu, Busan, using a verification color pen to enter “E” in the name column; and (b) signed on the side of the name.
