Where the defendant fails to pay the above fine, 50,000 won shall be one day.
Reasons
Punishment of the crime
A. At around 11:00 on January 16, 2012, the Defendant: (a) visited the mobile phone agency B at Silung-si to enter “C”; (b) in the name column of customer information on the application for subscription to a new service contract (for the storage of customers) paper printed by the verification-type pen; and (c) written “C”, “E”, “E”, “E”, and “C” in the name column of the bank (credit card company); and (d) in the name column of the bank (credit card company) “C”; and (e) written “C”, “G”, “C”, and “C” in the resident registration number column of the deposit holder (credit card company) column.
In addition, among the purchase customer information of the paper for the contract for the installment transaction of a device printed by the above method, the phrase “C”, “D”, “E” in the phone number column for contact, and “C” in the application customer column were stated respectively, and written “C” and “C” in the printed document for the consent to collect personal location information in the application customer column.
Accordingly, for the purpose of exercising authority, the Defendant forged a new contract on mobile phone in the name of C, a contract on the installment of a device, the consent to the collection and use of personal location information in SKpl unit(s) and one copy of the application for the subscription to radioNET service.
B. The Defendant, at the above time and at a place, issued and exercised the following: (a) the resident registration certificate of C and the agricultural bank account (C account number) that he/she acquired to H of a mobile phone agent who is aware of such fact; and (b) as if he/she duly completed the required new contract at the time of joining the forged mobile phone, he/she received one cell phone (Aphone 4S and approximately 9.50,000) from the above H, and took property benefits.
