A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant is a person who served as a business employee at the same place of business where B Co., Ltd. (hereinafter “B”), and was engaged in the business of supplying B goods to “D Et” operated by C from March 22, 2014 to August 31, 2016, and collecting the price from C.

피고인은 사실은 B 안동 영업소에 등록되지 않은 거래처에 제과를 납품하였음에도 불구하고 마치 D 마트에 제과를 납품한 것과 같은 외관을 창출하여 그에 상응하는 물품대금 상당의 이익을 가로챌 목적으로 C 명의의 ‘ 거래카드 ’에 허위채권을 기재하기로 마음먹고, 2016. 7. 경 불상의 장소에서 C 명의의 ‘2016 년도 7월 자 거래카드’ 의 ‘ 월일’ 란에 ‘7 /28’ 을, ‘ 매출액’ 란에 ‘459,917’ 을, ‘ 잔 액’ 란에 ‘12,067,101’ 이라고 각 기재하고 ‘ 대표자 확인’ 란에 ‘C’ 이라고 서명하고, 2016. 8. 경 불상의 장소에서 위 거래카드의 뒷면 인 ‘2016 년도 8월 자 거래카드’ 의 ‘ 월일’ 란에 ‘8 /18’ 을, ‘ 매출액’ 란에 ‘273,678’ 을, ‘ 잔 액’ 란에 ‘11,951,549 ’라고 각 기재하고 ‘ 대표자 확인’ 란에 ‘D’ 이라고 서명하였다.

Accordingly, for the purpose of exercising authority, the Defendant indicated C’s name and trade name without authority, and puts his signature, respectively.

2. From July 2016 to August 2016, the Defendant: (a) presented the transaction card on which the forged signature was written to F at the head of the Dong-dong B’s place of business located in Ansan-si; (b) to C who is aware of the forgery; and (c) to C, who was aware of the forgery at the D E-dong G located in Chungcheongnam-gun, Gyeongbuk-gun; and (d) presented the transaction card with the forged signature as if it was genuine.

3. From July 28, 2016 to August 2016, the Defendant: (a) presented to the victim a transaction card with the signature of the victim C who forged as above; (b) goods equivalent to KRW 459,917 from the victim B on July 28, 2016; and (c) goods equivalent to KRW 459,917 from the victim B on July 28, 2016.
