Punishment of the crime

[criminal power] On November 11, 2009, the Defendant was sentenced to three years and eight months to imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and a crime of fraud, etc. at the Daegu District Court. On October 1, 2014, the Defendant was sentenced to imprisonment with prison labor for a crime of larceny at night, etc. at the Chuncheon District Court, and on September 30, 2016, the Defendant was sentenced to six months of imprisonment with prison labor and three years of imprisonment with prison labor for larceny, etc. at the Seoul Central District Court, and completed the execution of the sentence on September 15, 2019.

【Criminal Facts】

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and intrusion on structures;

A. On September 20, 2019, at around 13:00 to 13:05, the Defendant entered the above hospital for the purpose of theft of money and valuables in front of the D rehabilitation department worked by the victim C in Seongbuk-gu, Sungnam-si. On September 20, 2019, the Defendant: (a) entered the above hospital; (b) entered the said hospital’s original director-general; (c) entered the said hospital’s office; (d) 50,000 won in cash; (b) entered the victim’s new bank card under the name of the victim; and (c) took one half-proof for male use at the market price equivalent to KRW 1.2 million in total

B. On October 2, 2019, at around 11:46, the Defendant entered the restaurant with the intent to steal money and valuables from “G” exclusive delivery restaurant operated by the victim FF in Dong-gu, Nam-gu, Dong-gu, Dong-gu. The Defendant stolen the money and valuables. The Defendant, using the gaps in which the victim took care of his work at the kitchen, carried out a cafeteria with the victim’s cash 100,000 won on the restaurant table, and stolen it.

C. On October 2, 2019, around 14:48, the Defendant: (a) entered the said gold bank with the intent to steal money and valuables in front of the “J” bank operated by the victim I at Sejong-si; (b) went into the said gold bank for the purpose of theft; and (c) took advantage of the gap in the victim’s care, the Defendant stolen 30,000 won at the market price of the victim’s 6.6 million won at the front line with one point.
