A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Forgery of private documents and the uttering of a falsified investigation document;

A. On November 2012, the Defendant applied for the purchase of the Hyundai Card in B’s name at the “D” mobile phone sales store operated by the Defendant in Daegu-gu, Daegu-gu, the Defendant entered the customer information column for the membership of the Hyundai Card as “B, resident registration number (F), and Bupyeong-gu Incheon Metropolitan City Bupyeong-gu G Building 502,” respectively, and signed the name side of B in the applicant and deposit note, and submitted the completion of the membership application to the members of the Hyundai Card’s business who found the place in that place as genuine.

B. On June 2013, the Defendant applied for the issuance of a credit card under the name of E, at the Defendant’s house located in Gyeyang-gu Incheon Y apartment 522 dong 614, the Defendant stated “E, resident registration number (I), J, Incheon Gyeyang-gu apartment H 522 dong 614,” and the applicant’s name as “E” in the customer information column for the application for the membership of Samsung Card member as “E” and signed on the name side of the applicant, and submitted the completion of the application to the Samsung Card operator as if the application was genuine.

B Around August 2, 2013, the Defendant prepared a loan agreement with the content that “B borrowed KRW 7 million at 29.9% per annum on the condition that the principal and interest of each month during three years from August 2, 2013 were repaid at interest rate from August 2, 2013 at the 5th floor of Bupyeong-gu Incheon, Bupyeong-gu Office of Social Loan Co., Ltd. on the 5th floor of Bupyeong-dong 534-27, Bupyeong-gu, Incheon, and submitted the said loan agreement to the customer name, stating the name and resident number in the customer name, signing in that name, and submitting the said loan application to the employees of the said company as genuine.

Accordingly, for the purpose of uttering, the Defendant forged the application form for the membership of the Hyundai Card and Samsung Card Member under the name of B and E, which is a private document related to rights and duties, and one copy of the loan application form under the name of B, respectively, and exercised it as above.

2. Fraud.
