A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

1. On March 2010, the Defendant found one driver’s license that the victim D lost on the way in which the victim D lost on the roads in the south-gu, Dong-gu, Chungcheongnam-gu, Seoul, the end of March 2010.

The Defendant, without going through necessary procedures such as returning the above acquired property to the victim, embezzled it on his own idea.

2. The Defendant forged a private document, uttering a falsified private document, and acquired a D’s driver’s license, using it, forged an application for joining a mobile phone, and received a mobile phone.

On December 27, 2011, the Defendant forged private document 1) filed an application for new entry of F mobile phone (a model name: A780L/420810) in E located in thecheon on December 27, 2011, and presented D’s driver’s license to the above store employees in his/her name, and written D’s license in the column of customer name of the upper end of the application form “D”, “G”, and “D” in the column of signature. Accordingly, for the purpose of exercising rights and duties, the Defendant forged one copy of the application for mobile phone entry in the name of D, which is a private document related to rights and duties. 2) In order to exercise, the Defendant used the forged application for mobile phone entry in his/her name, as seen above, as if he/she had been duly formed.

3) The criminal defendant presented one of the above forged mobile phone subscription applications and the above D's resident registration certificates embezzled by the defendant in his/her job, and, as if he/she was delegated by D, deceiving employees in the victim E's name in his/her job and was delivered one of the F's mobile phones (a model name: A780L/420810) equivalent to the market price of 58,000 won from his/her job, from the employee. (b) On January 5, 2012, the criminal defendant forged private document at H agency located in Gyeonggi-do, applying for new subscription of I mobile phone (a model name: I-4S) at H agency around January 5, 2012.
