Reasons
Punishment of the crime
Around May 201, the Defendant and B failed to meet the cost of living and entertainment. Around May 201, the Defendant offered mobile phone, passbook, and the Internet portal site IDs, etc., and the Defendant posted a false advertisement as if he sold the goods, and conspired to receive the payment from the victims who contacted with them, and then divide the profits therefrom.
1. On June 8, 2011, the Defendant and B, according to the above public offering, up to the PC room where the trade name in Yeonsu-gu Incheon, Yeonsu-gu, Incheon is unknown, the Defendant posted an advertisement to the effect that “I sell Boanampha 5DSR camera” on the Internet site Nuri Mandoro, and then, reported this advertisement to the victim C who visited the victim C, who received the pre-paid goods and delivered the Kamera to the Kamer.
The Defendant and B made a false statement. However, the Defendant and B did not have the DSSR camera and did not have any intent or ability to deliver the DSSR camera to the victim as a cost of living and entertainment. On June 14, 201, the Defendant and B sold the PC in which the trade name in Yeonsu-gu Incheon, Yeonsu-gu, Incheon, could not be known. The Defendant and B sold the DESR camera to the Internet site, “DSLR camera” in the NA, N. L., N. L.
“The advertisement posts the contents, and the victim E who reported and contacted this, will deliver the Kameras to the victim E after receiving the advance payment.
"Finally, it made false statements."
However, even if the defendant and B receive the payment from the victim, they did not have the intention or ability to deliver the camera.
The Defendant and B, as mentioned above, had the victim induced and had the victim delivered KRW 540,00 to the above new bank account in the name of B.
