The defendant shall be innocent.
Reasons
1. Around April 7, 2001, the Defendant married with F on and around July 17, 201, but filed a divorce or solatium claim against F on and around July 17, 2013, and FF also filed a counterclaim on October 24, 201, and currently pending a divorce lawsuit.
The Defendant was not entitled to withdraw money from F to F with the notification that he would no longer withdraw or use the money deposited in F’s account due to property management problems. On March 22, 2013, the Defendant transferred F’s cash bank card in the name of F, which was held in front of the automatic withdrawal period for the management of the victim’s national bank established at Seocho-gu Seoul Seocho 2, Seocho-gu, Seocho-gu, Seoul, the cash bank card in the name of F, which was held in front of the automatic withdrawal period for the said cash withdrawal period, to the Defendant’s bank account (Account Number:G) in the name of F, and then immediately transferred KRW 5 million managed by the victim to H.
In addition, from March 22, 2013 to July 22, 2013, the Defendant acquired pecuniary benefits equivalent to KRW 1,9320,000 by automatic transfer to the Defendant’s above account using F’s cash card without authority over a total of eight occasions, such as the statement in the list of crimes in the attached list of crimes.
Accordingly, the defendant acquired financial benefits equivalent to 19,320,000 won by inputting the information without authority into the data processor, such as computer, etc.
B. Around April 8, 2013, the Defendant: (a) requested F to cancel the sales contract for a commercial building; (b) the Defendant requested F to cancel the sales contract; and (c) made an application for registration of the said commercial building rental business operator without the consent of F to the effect that the F, Songpa-gu Seoul Special Metropolitan City I commercial building sales balance 60 million won and the seal impression necessary for the registration of a rental business operator, which was sold in F under the name of F.
