A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant had a view that C entered the password in the course of account transaction using the sponsor banking service of a national bank, and had a view that C came to know of the above password by using C’s cash card of the national bank.
1. Larceny;
A. On May 22, 2014, the Defendant committed the crime of May 22, 2014, at around 08:00 Gangwon-do, the victim credit union, located in 71, Seocheon-ro, Gangwon-do, Gangwon-do, Gangwon-do, which was managed by the victim union, posted C’s cash card to ATM and then withdrawn one million won in cash, which is the victim’s possession, by entering a password prior to the entry.
B. The Defendant committed the crime of June 13, 2014, at the victim community credit cooperatives around 12:00, located at 433 o, 6, as the rain of Yeonsu-gu Incheon, Yeonsu-gu around 12:00, and A.
In the same way, 2 million won of cash owned by the victim was withdrawn and stolen.
2. Around 08:00 on May 22, 2014, the Defendant used computers, etc.
At the place stated in the subsection, the victim credit union, entered the cash card of the national bank in ATM, which is the information processing unit managed by the victim credit union, and entered the bank password of C, the defendant's account number, and the amount to be transferred to the defendant's community credit cooperatives account through ATM, and obtained financial benefits equivalent to the same amount by allowing the defendant to transfer 18 million won to the defendant's community credit cooperatives account through ATM.
In addition, as shown in the attached list of crimes, the Defendant acquired financial benefits equivalent to the same amount by allowing the victims to transfer KRW 31,500,000 from the national bank account in the same way seven times from around that time to July 25, 2014.
