A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. A violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Aggravated Punishment, etc. of Specific Crimes) stated that the Defendant, at around 00:01 on November 26, 201, on the street in C, a passenger taxi driven by the victim D (the age of 65) is able to take care of the victim’s personal taxi in front of C, and that the victim is “I son?????????????????????????????????????????????????????????????????????????????????????????????????????

Accordingly, the defendant assaulted the victim who is a driver of a vehicle in operation.

2. Performance of official duties;

A. On November 26, 2019, at around 00:34, the Defendant: (a) confirmed the Defendant’s personal information at the G police box parking lot located in the Saby-si F; (b) the police box belonging to the Saby-si Police Station that received a report of damage from the said D; and (c) the Defendant took one time the victim’s face by sounding “Ya-si sawk?” and taking the victim’s face by drinking.

이에 G파출소 소속 경장 I 등이 피고인을 공무집행방해 현행범으로 체포하고 같은 날 00:36경 G파출소 내 의자에 앉힌 후 수갑을 고정하려 하자 피고인은 발로 경장 I의 허벅지를 1회, 경위 J의 허벅지를 2회 걷어차고, 이빨로 순경 K의 머리카락을 1회 물어뜯고 발로 위 K의 배를 1회 걷어찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the handling of report by police officers and the arrest of flagrant offenders by force.

나. 피고인은 같은 날 02:18경 G파출소 앞 노상에서 G파출소 소속 순경 L이 피고인을 순찰차 뒷좌석에 태워 여수경찰서로 인치하려 하자 차 바닥에 누워 발로 위 L의 머리를 1회 걷어찼다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers in the act of committing the crime.
