A A shall be punished by a fine of two million won, by a fine of two million won, by a fine of two million won, and by a fine of three million won.

Punishment of the crime

1. Defendant A subscribed to the Korea Sports Foundation for the Seoul Olympic Games and the Korea Sports Promotion Foundation, which was operated by a person who is not the entrusted business entity, as a member of the "D" site for illegal sports discussions operated by those who are not the entrusted business entity.

On May 28, 2015, the Defendant: (a) transferred KRW 300,00 to the Agricultural Cooperative account in the name of the Defendant at the Defendant’s house (F) located in the name of the Defendant to the Agricultural Cooperative account in the name of the said site; and (b) deposited the game money used for gambling by predicting the result of the winning, unclaimed, and failure of the overseas sports games; (c) received dividends according to the dividend rate and received money from the said Defendant with the said Defendant’s account using; (d) from the above date to October 21, 2015, the Defendant deposited the said website with the total amount of KRW 56,000,000 in total, as shown in Annex A, from around 16,000 to October 21, 2015.

As a result, the defendant was gambling by issuing sports promotion voting rights or similar things to those who were not the Seoul Olympic Winter Games Foundation and those who were not the entrusted business entity.

2. Defendant B subscribed to the Korea Sports Promotion Foundation for the Seoul Olympic Games and the Korea Sports Promotion Foundation, which was operated by a person who is not the entrusted business entity, as a member, such as “D”, “H”, etc.

On May 2, 2015, the Defendant: (a) transferred KRW 200,00 to the national bank account under the name of the Defendant (J) at the Defendant’s home located in Daegu Northern-gu 103-dong 405, to the deposit account in the said website; and (b) received the money for the game used for gambling by remitting KRW 200,00 from the national bank account under the name of K; and (c) opened the game money by predicting in advance the result of the winning, unclaimed, and failure of the overseas sports game; and (d) opened the game money, the Defendant’s dividend rate is calculated.
