A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant stated that “The Defendant would sell game money” at the Internet game “C” in a place where his name cannot be known around March 6, 2019, and that “the Defendant would send 400,000 gress (game money) if he remitted KRW 280,000 to the victim D who had contacted with the Defendant.”

However, even if the defendant received money from the victim, he did not have the intent or ability to sell the said game money.

The Defendant received 280,000 won from the victim to the Defendant’s E account as the price for the said game money on the same day. From around that time to March 30, 2019, the Defendant received a total of 709,000 won from the victims to the said account by the same method as shown in attached Table 1, in total six times from around that time, as shown in attached Table 1.

Accordingly, the defendant was provided property by deceiving the victims.

1. Fraud - The Defendant: (a) at a place where no name is known on March 23, 2019; and (b) at the online game “F,” the Defendant posted a letter to the victim G who had contact with the “F to sell the game money” and reported it to the effect that the Defendant would send 20 million won if he remitted KRW 82 million to the victim G.

However, even if the defendant received money from the victim, he did not have the intent or ability to sell the said game money.

The Defendant received 82,00 won from the victim to the Defendant’s Hbank account for the same day as the price for the said game money. From around that time to April 13, 2019, the Defendant received the total amount of KRW 692,700 from the victims as the price for the game money by the same method eight times in total, as shown in attached Table 2 of Crimes List 2, from around that time.

Accordingly, the defendant was provided property by deceiving the victims.
