A defendant shall be punished by imprisonment for not less than two years and six months.

An application for remedy by an applicant for remedy shall be dismissed respectively.

Punishment of the crime

1. On July 4, 2019, the Defendant: (a) committed a violation of the Aggravated Punishment, etc. of Specific Crimes (thief) of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) around 20:30, the Defendant: (b) committed a theft of the victims’ property in total amount of KRW 887,000,00 at seven times in total, as shown in Table 1 of the Aggravated Punishment, etc. of Specific Crimes (i.e., the market price of the victims, including the victim’s property, or damaged part of the building, such as door door, at night, and invaded the victim’s property by breaking the victim’s cell phone.

Accordingly, the defendant was sentenced to imprisonment more than three times due to larceny, etc. and stolen the victims' property during the period of repeated crime.

2. On July 4, 2019, the Defendant violated the Fraud and the Specialized Credit Financial Business Act: (a) around 20:41, the Defendant used a stolen physical fitness card by presenting it to the victim as if he had a legitimate title, as described in paragraph (1), at the first convenience point for the operation of the Victim H located in G in the original city; (b) and (c) making payment, as if he had a legitimate title; and (d) can be cans equivalent to KRW 2,150 at the market price from the victim, namely, from the victim.
