A defendant shall be punished by imprisonment for not more than ten months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant was a foreigner of the nationality of AFO, and on December 2010, the facts were considered to have been employed in the Republic of Korea and asked C to arrange the issuance of a visa by pretending to enter the Republic of Korea as if he were to enter the Republic of Korea, and to arrange C, a broman, a false visa issuance, with the consent of the above C.
The Defendant, around that time, through H, who is the actual operator of D E, E (hereinafter “E”) and F Textiles companies (Y in Yangju), who received the above Defendant’s intent from the above C, solicits the Defendant to Korea for the consultation on the export and import of Belgium F Textiles, and the conclusion of a contract. Following the delivery of evidentiary documents necessary for visa application, such as a letter of false invitation, a letter of intent to promote the project, and a schedule of stay, the Defendant was scheduled to stay in the Republic of Korea on December 24, 2010 for 90 days for the purchase of domestic textile in the Republic of Korea located at the Embassy of the Republic of Korea of ASEAN, the said false document was submitted to the public official in charge of the issuance of the Belgium F Textiles to verify the entry, etc. from the said public official, and the said false interview was issued from the above public official in charge of the affairs of the issuance of the Belgium for the purpose of entry from the said international official, and the said visa was issued from the above public official in charge of the 10th of the 31st of the Incheon Airport.
As a result, the Defendant interfered with legitimate performance of duties concerning visa issuance duties of public officials belonging to the Embassy of the Republic of Korea of the Republic of Korea, and at the same time applied for a false visa to enter the Republic of Korea by fraudulent means.
