1. The defendant A shall be punished by imprisonment for two years;
However, the execution of imprisonment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendants A and B conspired to attract children and juveniles to return to the late night so that they have sexual intercourses with many and unspecified men by receiving money, and then they conspired to take money from the other male and female victims as if they were the siblings of victimized children and juveniles. A.
On March 15, 2014, the Defendants: (a) committed a violation of the Act on the Protection of Children and Juveniles against Sexual Abuse; (b) made the victim F (n, 14 years old), G (n, 14 years old), and H (n, 14 years old); and (c) made the victim to a vehicle operated by Defendant A as if the victims were to be protected; and (d) explained the victim’s plan to “at least 5 million won and at least 10 million won and 10 million won and 10,000,000 won may be punished for a month in which Korea would act as a broker to meet the terms and conditions; and (e) made the victim F to agree with the victim F by having him/her receive money only on the condition that he/she would receive money.”
B. At around 12:30 on March 16, 2014, Defendants of the violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (business brokerage, etc.) agreed on the amount and the place where Defendant A colored the other party to whom he/she will take over the conditions through a mobile phone, and Defendant B confirmed the personal information of the subject male to take over the future money fraud in the future, and then, around 13:00 on March 16, 2014, Defendant B arranged for commercial sex acts by allowing the name-free male and F to take out the name-free female sexual intercourse with the trade in Songpa-gu Seoul, Songpa-gu, Seoul to take over 100,000 won in return for purchasing sex.
C. Defendants in violation of the Punishment of Violences, etc. Act (joint conflict) are jointly committed on March 2014.
