The defendant shall be innocent.
Reasons
1. Summary of the facts charged
A. On August 12, 2003, the Defendant’s employees B violated the restriction on the operation of the road management authority by operating C Freight Trucks owned by the Defendant as loaded more than 1.22 tons at the business office of the Korea Highway 26.9km in the 2nd line, the 2013 Go-Ma1454 (C Freight Trucks on October 7, 2003) around August 12, 2003 with respect to the Defendant’s duties, around 22:10 on August 12, 2003.
B. The Defendant’s employees D, as of April 26, 2004, was in violation of the restriction on the operation of the road management authority by operating the freight truck owned by the Defendant under the condition that the Defendant was loaded with the Defendant’s 1.7 tons of at least KRW 5 tons from Jincheon-si, Incheon at around 19:02, around March 22, 2004 with respect to the Defendant’s business.
C. Around June 25, 1999, around 00:18, 2013 Highest 1456 (Summary Order subject to Retrial: 200 Highest 27258, Nov. 6, 2000) Defendant’s employee F violated the restriction on the operation of the road management authority by operating the freight truck owned by the Defendant in excess of 1.82 tons in the 2nd line, and 1.78 tons in the 3rd and 3rd column.
On May 20, 200, the Defendant’s employees G violated the restrictions on the operation of H truck owned by the Defendant by operating the Defendant’s H truck as loaded more than 0.2 meters in height on the 1st line on the 1st line of Sacheon-si National Highway in Yancheon-si, Yancheon-si, at around 15:14, May 2000, as the Defendant’s employees G violated the restrictions on the operation of the road management authority.
E. Around September 16, 1998, 2013 Highest 1458 (Order of Summary: 2001 Highest 4847 March 13, 2001) Defendant’s employee I, with respect to the Defendant’s work, violated the restriction on the operation of the road management authority by operating the J Cargo Truck owned by the Defendant as he loaded more than 1.5 meters in width, on September 23, 1998 with respect to the Defendant’s work.
