피고인은 2018. 2. 12. 전북 고창군 B에 있는 비닐하우스에서, 그곳 바닥에 멍석을 깔아두고, 윷판, 윷, 화투 등의 도박도구, 전기난로, 의자 등의 편의시설, 믹스커피, 온수, 컵라면 등을 비치해 둔 다음, 인근 지역에서 피고인의 연락을 받고 위 비닐하우스에 모여든 다수의 사람들로 하여금 같은 날 15:30경부터 18:13경까지 그곳에서 각자 윷을 던질 선수 2명 중 1명에게 돈을 걸고 그 선수들 간의 윷놀이 결과에 따라 승패가 결정되는 윷놀이 방식의 도박 및 화투 5장을 1묶음으로 하여 4개로 패를 나눈 후 각자 1개의 패에 돈을 걸어 각 패의 숫자를 합산한 끝자리 수의 높고 낮음에 따라 승패가 결정되는 방식의 이른바 ‘도리짓고땡’ 도박을 수회에 걸쳐 하도록 하고, 매회 도박의 승자로부터 취득한 돈 중 10%를 지급받았다.
