A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On July 201, 2014, the Defendant: (a) around 01:00, the Defendant: (b) came to have his own idea without following the necessary procedures, such as acquiring two coloring agents on the market price, which is the ownership of the lost victim on the road near Busan Jin-gu, Busan; and (c) returning it to the victim.

2. On April 26, 2015, the Defendant violated the Specialized Credit Financial Business Act: (a) around 06:27, the Defendant settled the price using the Busan Bank Body Card, which was found to be 1,600 won in the market price, at the self-board shop owned by the victim in the name-unclaimed area located in the Seodong-dong, Busan Metropolitan City; (b) around 06:27, the Defendant paid the price by using the above crime sight card No. 1 6.
Accordingly, the defendant stolen the property owned by the victim and used the lost debit card.
3. On May 5, 2015, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) purchased tobacco 2 A at the R convenience store located in Q Q of Busan, Busan on May 5, 2015; (b) and (c) presented the Victim’s Name-Inward Card No. 1 No. 7 as if the Defendant was his card, and paid KRW 9,000 for the purchase price, 9,000.
However, the facts are not the legitimate holder of the above card, and the defendant did not have the intention or ability to pay the price normally to the victim.
Accordingly, the Defendant, by deceiving the victim, acquired 2 A tobacco equivalent to KRW 9,000 of the market price immediately from the victim, and used a lost debit card, and as shown in the attached Table 2 from that to May 15, 2016, 405,030 won in total 22 times from that time.
