A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who sells miscellaneous, etc. at a “C” store located in Busan Jung-gu.

피고인은 2013. 5. 22. 13:50경 부산 중구 D에 있는 ‘E식당’ 4층 가건물의 창고에서 F로부터 프랑스 ‘루이비똥말레띠에’사, ‘샤넬’사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사가 각각 대한민국 특허청에 가방, 지갑 등을 지정상품으로 상표등록한 ‘루이비똥(LOUIS VUITTON, 등록번호 제4001255390000호)', '샤넬(CHANEL, 등록번호 제4000713240000호 등)', ‘구치(GUCCI, 등록번호 제4000703520000호 등)’와 동일ㆍ유사한 상표가 부착된 수량을 알 수 없는 가방, 지갑 등을 공급받아 판매하고 279점(가짜 루이비똥 가방 63점, 가짜 루이비똥 지갑 101점, 가짜 루이비똥 쌕가방 20점, 가짜 루이비똥 명함지갑 43점, 가짜 샤넬 지갑 25점, 가짜 구치 지갑 27점 등 정품 시가 약 2억 2,760만 원)을 판매목적으로 보관하였다.

Accordingly, the defendant infringed the trademark rights of the above trademark right holder.
