피고인은 2013. 8. 28. 15:10경 위 장소에서 부산 D시장의 ‘E’으로부터 상표권자인 프랑스 ‘루이비똥말레띠에’사, 프랑스 ‘샤넬’사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사, 룩셈부르크 ‘프라다 에스.에이’사, 영국 ‘버버리리미티드’사, 프랑스 ‘크리스티앙디오르꾸뛰르’사, 이탈리아 ‘살바토레 페라가모 이탈리아 에스.피.에이’사, 미국 ‘리버라이트 브이, 엘.피’사가 대한민국 특허청에 그 지정 상품을 가방, 지갑 등으로 정하여 등록한 ‘루이비똥(LOUIS VUITTON, 등록번호 제4001255390000호)', '샤넬(CHANEL, 등록번호 제4000713240000호 등)', ‘구치(GUCCI, 등록번호 제4000703520000호 등)’, ‘프라다(PRADA, 등록번호 제4003502060000호)', '버버리(BURBERRYS, 등록번호 제4003624630000호 등)', ‘크리스챤 디올(Christian Dior, 등록번호 제4000463200000호)', ‘살바토레 훼레가모(SALVATORE FERRAGAMO, 등록번호 제4001376700000호)’, '토리 버찌(TORY BURCH, 등록번호 제4008131030000호)'와 동일유사한 상표가 부착된 수량을 알 수 없는 가방, 지갑 등을 공급받아 판매하고, 나머지 163점(정품 시가 약 1억6,490만 원)을 판매 목적으로 보관하였다.

Accordingly, the defendant infringed the trademark rights of the above trademark right holder.
