Defendant shall be punished by a fine of KRW 1,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[Presumptions] The Defendant is the chairman of the D Association of Party Members Council of Party B.

In relation to the F election to be held simultaneously with the E election (hereinafter “instant election”), the Defendant was anticipated to have six persons who wish to leave the C constituency as a candidate for the C election district under the control of the political party B in December 2019, and the Defendant was organized “F candidate single candidate affiliated with the B political party” in advance to avoid unnecessary competition and to hold the members with a single candidate centering around a single candidate. The Defendant was organized “F candidate single promotion committee (hereinafter “promotion committee”) with the Defendant as its chairperson, G, C Women’s Chairperson, C C advisory Chairperson, C advisory Chairperson I, C advisory Chairperson I, C advisory Chairperson I, C advisory Chairman of the J party, C Youth Chairman, C Youth Chairperson L, C Council member M, N, andO, etc., who is the Defendant as its chairperson.

On January 1, 2020, Q in the Chungcheongbuk P, five candidates wishing to become a candidate for the election district C of the instant election under the control of B political party, and B made an unofficial vote among party members C of the political party, and elected R as a single candidate.

[Criminal facts] No person may make contributions to an election for a candidate or a political party to which he belongs.

Nevertheless, the Defendant had a mind to make contributions for R and B party as a person who wishes to be a candidate with respect to the election of this case.

Accordingly, on January 2020, the Defendant directed the executive secretary S of the Promotion Committee to prepare a meal site and gift by stating that “The members of the Promotion Committee were allowed to buy it, and the gifts will also be prepared.”

At around 12:00 on January 2, 2020, the Defendant provided 10 members of the electoral districts, including G, H, I, K, L, V, M, N,O, and S, with meals and alcoholic beverages worth KRW 308,00,00, for the purpose of the person who wishes to be a candidate for the instant election, and for the Party R and B.
