A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant of "2019 Highest 1868" is not a narcotics handler.

1. Violation of the Act on the Control of Narcotics, etc. (fence) - Trading of phiphones;

A. On June 9, 2018, the Defendant, around June 9, 2018, intended to purchase phiphones from B to a bank account (D) designated by B, and purchased phiphones by means of bringing about approximately 0.5g of phiphones kept in the inside and outside of the gas pipes near Gangnam-gu Seoul Metropolitan Government E on the same day.

B. On June 11, 2018, the Defendant, on June 11, 2018, decided to purchase phiphones from B to the F bank account (G) designated by B, and purchased phiphones in a way that B brings about 0.5g of phiphones kept in the outside machine of Gangnam-gu Seoul H H HH air-conditions on the same day.

C. On June 15, 2018, the Defendant, around June 15, 2018, intended to purchase phiphones from B, and purchased phiphones by means of remitting KRW 400,000 from B to the F bank account (I) designated by B, and bringing about approximately 0.5g of phiphones kept by B in the vicinity of Seoul JJ on the same day.

On July 5, 2018, the Defendant, around July 5, 2018, intended to purchase phiphones from B, transferred 400,000 won of phiphones to the F bank account (K) designated by B, and purchased phiphones in the way of bringing about 0.5g of phiphones kept by B in Seoul, Gangnam-gu Seoul on the same day.

E. On January 30, 2019, the Defendant, on January 30, 2019, decided to purchase a penphone from a person with no name who uses a “N” in MM on January 20, 2019. On January 30, 2019, the Defendant deposited KRW 400,000 from a bank account in the name of anO designated by the person with no name, and purchased a penphone in such a way as to bring about the number of a penphone kept by the person with no name in his/her name on the upper right side of the Q address of Gangnam-gu Seoul Metropolitan Government on the same day.
