A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Even if the Defendant is not a narcotics handler, he dealt with psychotropic drugs-related Mespophopys (one philopon; hereinafter “philopon”) and marijuana as follows:

1. Violation of the Narcotics Control Act;

A. On March 23, 2019, around 10:16, the Defendant purchased phiphones from the Cbank DF Center located in Hanam-si B, to purchase phiphones from the seller of philograms (E) through telegrams, to deposit KRW 1 million in the name of F CF bank (G) account designated by the winners of philophones. On the same day, at around 10:40 of the same day, the Defendant purchased phiphones with 0.5g of philophones contained in plastic bags concealed by the above winners of H building at the first floor of Songpa-gu Seoul, Songpa-gu.

B. At around 12:30 on March 23, 2019, the Defendant administered philophones by inserting 0.15g philophones into a single-use injection machine at the Defendant’s residence located in Hanam-si I, and dilution with water, and in the way of injection into the Defendant’s arms.

2. Violation of the Act on the Control of Narcotics, etc.;

A. On April 3, 2019, around 17:30, the Defendant: (a) purchased marijuana at the point of the designated branch of the K Bank located in Gangnam-gu Seoul Gangnam-gu, Seoul, to purchase it from a seller of the hemp in his name via the telegram (referred to as “L” and “M”; (b) deposited KRW 90,000 in the N Bank (O) account in the name of the person who was designated by the above winners; and (c) purchased marijuana in the form of 0.5g of the hemp concealed by the person who was not the winner of his name at the P in Seoul Special Metropolitan City, Nowon-gu at around 19:22 on the same day; and (d) purchased it over 4.5g of the total amount of marijuana by the above means, as described in the attached Table 1, from around that day to April 12, 2019.

B. On April 3, 2019, the Defendant of the hemp smoking: (a) puts in the alleyway in the alley-dong, Gangnam-gu, Seoul, by the horse, the string of which is less than 0.5g of tobacco; and (b) inhales the smoke by attaching the string to it.
