Defendant shall be punished by a fine of KRW 7,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. 업무방해 피고인은 2013. 1. 27. 09:00경부터 같은 날 10:00경까지 경북 영덕군 C 피해자 D이 운영하는 E식당 내에서 술에 취해 위 식당의 다른 손님들과 종업원들에게 "개 좃같은 새끼들"이라며 욕설을 하고 시비를 거는 등 행패를 부려 피해자의 E식당 운영 업무를 방해하였다.

2. 공무집행방해 피고인은 제1항과 같은 날 10:15경 위와 같이 행패를 부리던 중, 신고를 받고 출동한 영덕경찰서 F파출소 순경 G, 경사 H으로부터 제지당하자, 위 경찰관들에게 “이 새끼야 닌 뭐냐, 좃같은 놈들아” 등의 욕설을 하고, 위 경찰관들에게 업무방해의 현행범으로 체포되어 경찰차에 탑승하여 경찰서로 가는 도중, 경찰관들에게 "야이 씹새끼들아, 내랑 함 싸우자, 발로 차뿔라"라며 욕설을 하면서 경찰차를 운전하고 있는 경사 H의 어깨를 발로 차고, 이를 제지하는 순경 G의 얼굴 부위를 주먹으로 2회 때리고, 허벅지를 3회 때렸다.

Accordingly, the Defendant assaulted police officers H and police officers G and obstructed the legitimate performance of official duties concerning the arrest of police officers in the act of committing a crime.
