1. 피고인 B, 피고인 C의 공동범행 피고인들은 2018. 5. 1. 16:30경 밀양시 F에 있는 G식당에서, 피해자가 피고인들의 누나인 E와 사귀면서 폭력을 행사하였다는 이유로 화가 나, 피고인 B은 그곳에 있던 테이블 1개를 뒤집어 엎은 후 한손으로 피해자의 멱살을 잡아 흔들면서 다른 한손으로 피해자의 테이블에 있던 소주병을 들고 피해자를 때릴 듯이 하면서 “개자슥 때려 죽인다”라고 위협하였고, 피고인 C는 그 옆에서 피해자에게 “이 개새끼, 개자슥”이라고 욕설을 하였다.

2. 피고인들은 공동범행 피고인들은 2018. 5. 1. 17:00경 창원시 의창구 동읍에 있는 본포다리 밑에서, 피해자가 피고인들의 여자 형제인 E와 사귀면서 폭력을 행사하였다는 이유로 화가 나, 피고인 A은 손바닥으로 피해자의 뺨 부위를 수회 때리고 발로 피해자의 옆구리 부위를 수회 차고, 피고인 C는 “야이 개 자슥아 내가 우리 누나한테 잘해라 안 하더냐”라고 욕설을 하면서 주먹으로 피해자의 온몸을 수회 때리고, 피고인 B도 주먹으로 피해자의 몸통 부위를 수회 때렸다.
