가. 피해자 H에 대한 폭력행위등처벌에관한법률위반(공동상해) 피고인들은 2014. 2. 12. 00:20경 경주시 I 소재 ‘J’ 식당에서, 주문한 비빔밥에 식은 밥이 나왔다는 이유로 피고인 B이 식당주인에게 욕설을 하고 밥그릇을 바닥에 집어던져 주위에 파편이 튀게 한 것에 대해 다른 손님인 피해자 H(37세)이 “옆 사람들에게 피해를 줘서 되겠느냐”고 항의하였다는 이유로 화가 났다.
