A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse;
A. 2. The defrauded stated that “If a sexual intercourse is made, 1.50,00 won will be given to the victim” on three occasions at the time and place specified in the above 1-B, C, and D.
However, even if the defendant has sexual intercourse with the victim, the defendant did not have any intention or ability to pay the price of sexual traffic as promised by the victim.
Nevertheless, the defendant deceivings the victim as such and acquired financial benefits equivalent to KRW 450,000 of the price for sexual traffic by sexual intercourses with the victim three times.
